General
By registering and/or participating, each participant agrees to comply with the Racing Sailing Rules 2025-2028, the rules of good sportsmanship, and all other rules applicable to this event, as well as the rules of the sailing associations and legal norms. Sailing is at their own risk, in accordance with Rule 4 of the WRS and upon acceptance of this Notice of Race.
The organizers/sponsors, their officers, and agents exclude all liability for damages of any kind and cause, whether on water or on land, including damage to crew, equipment, or financial loss. This exclusion of liability applies to damages occurring before, during, and after the event, but not (a) in cases of intent or gross negligence, (b) for personal injury in cases of gross negligence, or (c) for personal injury if, exceptionally, Section 6 (1) (9) of the Consumer Protection Act (KSchG) applies.
To the same extent, each participant waives any claims for damages against all persons (a) responsible for the conduct of the regatta (e.g., race director) or as referees, and/or (b) assisting the organizer at the organizer's request or on their behalf.
The burden of proof for slight and gross negligence, as well as for damages caused by unforeseeable and atypical hazards, rests with the participant.
Liability for lost items or damage caused by third parties, as well as for unforeseeable or atypical damages, is also excluded.
Audio and Video Recordings
By registering and/or participating, all participants agree that audio and video recordings of themselves and their boats/equipment may be made and published for an unlimited period of time for reporting on the event and for its promotion – including future promotion – as well as to promote the purposes of the organizing clubs.
Minors
For minor participants, their declarations of intent must also be submitted by their legal representative or by a person specifically authorized in writing by the legal representative.
Other
The organization of the event begins well in advance. No refund of the entry fee or travel expenses is provided. In exceptional cases, and only to the extent that the organizer has saved money, the entry fee will be refunded; however, this does not apply in cases of force majeure.
We reserve the right to make any necessary changes to the announcement and other rules (e.g., sailing instructions) but will be announced in a timely manner.
All prizes, especially non-cash prizes and souvenirs, will be forfeited if they are not collected in person at the awards ceremony.
For matters not subject to the autonomy of the sports (federation), the law of the Republic of Austria shall apply. The place of jurisdiction shall be the court with local and subject-matter jurisdiction for the event location.
